Terms and Conditions – BIANA BV

These Terms and Conditions apply to all offers, orders and agreements of BIANA BV, company number 1015.010.473, having its registered office at Rederijkersstraat 46, bus 5, 3500 Hasselt, Belgium, and relate to the use of the webshop www.binaparts.eu.

By placing an order via the webshop, the customer acknowledges having read and accepted these Terms and Conditions.

Article 1 – Definitions

Company: BIANA BV
Customer / Consumer: any natural person acting for purposes outside their trade, business, craft or profession.
Agreement: the purchase agreement concluded between BIANA BV and the customer.
Products: all goods offered via the webshop.

Article 2 – Applicability

These Terms and Conditions apply to every offer made by BIANA BV and to every distance agreement concluded between BIANA BV and the consumer.

Any deviations are only valid if expressly agreed in writing by BIANA BV.

The invalidity of one or more provisions shall not affect the validity of the remaining provisions.

Article 3 – The offer

The offer contains a complete and accurate description of the products offered. Images are for illustrative purposes only and may differ from the actual product.

Obvious errors or mistakes in the offer do not bind BIANA BV.

Article 4 – Conclusion of the agreement

The agreement is concluded at the moment the customer places an order via the webshop and BIANA BV confirms this order by email.

BIANA BV reserves the right to refuse orders or request additional information.

Article 5 – Age and legal capacity

Orders may only be placed by consumers who are legally capable. Minors may only place an order with the consent of their parent(s) or legal guardian.

Article 6 – Prices

All prices are stated in euros and include VAT.

Shipping costs are displayed separately during the checkout process and depend on the weight, volume and destination country.

BIANA BV is not bound by obviously incorrect price indications.

Article 7 – Payment

Payment must be made in advance using one of the available payment methods.

If payment is not received within 7 days of placing the order, BIANA BV reserves the right to dissolve the agreement.

Article 8 – Delivery

Delivery takes place at the address provided by the customer.

BIANA BV aims to deliver orders as soon as possible, with a maximum delivery period of 30 days.

If delivery within this period is not possible, the customer will be informed and has the right to terminate the agreement free of charge.

Article 9 – Risk and ownership

The risk of loss or damage to the products transfers to the consumer at the time of delivery.

Ownership of the products only transfers to the consumer after full payment of the amount due.

Article 10 – Right of withdrawal

The consumer has a right of withdrawal of 14 days from the day of receipt of the product.

During the withdrawal period, the consumer must handle the product and packaging with care.

The exercise of the right of withdrawal and the conditions for returns are described in the separate Return Policy, which forms an integral part of these Terms and Conditions.

Article 11 – Liability

BIANA BV is not liable for damage resulting from improper or incorrect use of the products.

This limitation does not apply in cases of intent or gross negligence, nor where liability cannot be excluded by law.

Article 12 – Warranty

BIANA BV provides the statutory warranty of conformity in accordance with Belgian law.

Article 13 – Force majeure

BIANA BV is not obliged to fulfil its obligations if prevented from doing so due to force majeure.

In the event of force majeure, obligations are suspended or the agreement is terminated if performance becomes permanently impossible.

Article 14 – Intellectual property

All content of the webshop, including texts, images and logos, is protected by intellectual property rights and may not be used without prior written consent.

Article 15 – Privacy

Personal data are processed in accordance with applicable data protection legislation. More information can be found in our Privacy Policy on www.binaparts.eu.
